Article 1: Purpose and presentation 

The present general conditions of sale govern the contractual relationship between SAS THITAN, operator of the www.cbde.fr website, and its customers. Any order validated by the consumer automatically implies the latter's unreserved acceptance of these terms and conditions of sale.

The said conditions may be modified by SAS THITAN, in which case the applicable conditions will be those in force on the site at the time of validation of the order by the consumer.

Article 2: Contractual information

In accordance with the provisions of the French Consumer Code, the online stores set up by SAS THITAN as part of its website must include the following information:

  • A presentation of the essential characteristics of the goods on offer.
  • An indication in Euros of the price of goods and services and delivery charges.
  • An indication of payment, delivery or performance charges.
  • Offer validity and price.
  • The existence of a right of withdrawal.

All information on our website www.cbde.fr is presented in French.

Article 3: Products

         Article 3.1 Prices

The prices of our products on the site are indicated in Euros, all charges included, excluding delivery costs. 

The selling price of the product is that in force on the day of the order.

Delivery and transport costs are mentioned before validation of the order and are invoiced in addition except when the order exceeds a sum previously announced on our website www.cbde.fr. They are indicated on the order summary.

Prices are subject to French VAT, and any change in the legal rate of this VAT will be implicitly passed on to product prices on the date stipulated by the relevant implementing decree.

SAS THITAN reserves the right to modify the prices of its articles at any time, however the products will be invoiced on the basis of the rates in force at the time the order is placed by the customer.

       Article 3.2: Availability 

The online sales offers presented on our site are valid for as long as the products appear in the electronic catalog and while stocks last, unless otherwise indicated.

In the event of unavailability and in accordance with article L 121-20-3 of the French Consumer Code, you will be informed either directly on our website, or by e-mail, or by telephone of items that are out of stock. Unavailable items will be reimbursed in the form of a credit note or bank re-credit on request.

         Article 3.3: Conformity of offers

The products comply with current French legislation and standards applicable in France. In accordance with article L 111-1 of the French Consumer Code, the consumer has the possibility of knowing the essential characteristics of the products he/she wishes to purchase before placing a final order.

Photographs or illustrations of products do not constitute a contractual document.

Article 4: Customer account 

Before placing an order on our site, the customer can create a customer account. To do so, they must fill in a form in the "my account" section, providing all the information required. The customer undertakes to ensure that the information provided is accurate, and not to impersonate a third party or change his or her age.

The customer must provide an e-mail address and a password that will be used to log in to the site at a later date. The login and password are personal and the customer undertakes not to divulge them.

Article 5: The order

    

        Article 5.1 : Placing an order

In accordance with the LCEN law of June 21, 2004, you have the opportunity to check the details of the order and its total price (including VAT and delivery charges) and to correct any errors before confirming it to express your acceptance. The present General Terms and Conditions of Sale come into force on the date of receipt of the validated order form on our website www.cbde.fr. We will acknowledge receipt of your order electronically without delay.

         Article 5.2 : Order modification

Any modification of an order after confirmation by the customer is subject to acceptance by the professional seller.

         Article 5.3: Archiving 

Purchase orders and invoices are archived on a reliable and durable medium that can be legally produced as proof.

Article 6: Payment 

        Article 6.1: Payment terms 

The price of the products is payable in full after confirmation of the order by the customer.

The customer's account will be debited on the day the order is dispatched.

Payment is made online by credit card or bank transfer.

      Article 6.2: Payment security

Our site includes a 3D secure system, for a completely secure payment. 

      Article 6.3: Default of payment

In the event of non-payment within 10 days, the contract will be automatically terminated.

Article 7: Delivery 

      Article 7.1: Delivery area 

SAS THITAN delivers throughout metropolitan France and the French overseas departments and territories, as well as throughout the European Union (depending on the legislation in force).

      Article 7.2 : Delivery times 

After validation of the order on our website www.cbde.fr , we undertake to deliver the products within :

  • 2-5 days in mainland France
  • 3-10 days within the European Union 
  • 10-20 days for French overseas departments and territories

The times indicated above do not include processing and delivery times.

Deadlines do not apply in cases of force majeure or acts of God.

      Article 7.3 : Delivery charges

Delivery charges are payable by the customer, except when the order exceeds a predetermined amount.

      Article 7.4 : Delivery terms 

The address you indicate on your order form is the one used for your delivery.

Deliveries are made by :

  • by delivery to your home by an external carrier.
  • by direct home delivery.

If the product is made available, it must be removed by the customer within fifteen days of the notice of availability.

In the absence of news from the customer within the time limit indicated, SAS THITAN may, after a formal notice from the customer, which has remained without effect, proceed with the withdrawal, cancelling the order by operation of law. Delivery costs will not be reimbursed, and any return costs will be charged to the customer.

     Article 7.5 Product conformity

If the product received does not conform to the order, the customer must send a complaint to SAS THITAN in order to obtain the replacement of the product or possibly the cancellation of the sale.

    Article 7.6 Delivery and transfer of risk

The seller chooses a carrier to make the delivery to the customer's home, and therefore travels at the seller's risk. 

When the customer takes physical possession of the goods, the risk is transferred to the buyer. This also applies to the risk of loss or damage, which is transferred to the customer or a third party designated by the customer at the time of physical possession.

    Article 7.7 Transfer of ownership

Ownership of the product is transferred to the customer upon actual delivery.

    Article 7.8 Late delivery 

If delivery is not made within 30 days of the online order date, the customer may request a refund from SAS THITAN.

This period does not apply in cases of force majeure.

     Article 7.9 Failure to deliver

Failure to deliver corresponds to total non-delivery, which entails automatic cancellation of the sales contract and reimbursement of the price paid, including delivery costs.

A delay or incident in delivery shall not be considered a default in delivery.

     Article 8: Legal warranty against hidden defects and conformity

All products supplied by SAS THITAN are covered by the legal guarantee of conformity stipulated in articles L.217-4 et seq. of the French Consumer Code, or by the guarantee against hidden defects stipulated in articles 1641 et seq. of the French Civil Code. 

SAS THITAN is liable for any hidden defects in the product sold which render it unsuitable for its intended use, or which impair this use to such an extent that the customer would not have purchased it, or would have paid a lower price for it, had he or she been aware of them. The customer may decide to invoke the Warranty against hidden defects of the item sold, as defined in article 1641 of the French Civil Code. In this case, the customer may choose between cancellation of the sale or a reduction in price by the seller in accordance with article 1644 of the French Civil Code.

Article 9: Right of withdrawal and return of ordered items

In accordance with articles L.221-5 et seq. of the French Consumer Code, the customer has a period of 14 days from receipt, by himself or by a third party, of the items ordered to exercise his right of withdrawal without having to justify his decision or pay any penalty.

To exercise the right of withdrawal, products must be new, unused and, if applicable, in their original box. Any product returned damaged and/or soiled by the customer will not be accepted.

To exercise the right of withdrawal, the customer must complete the withdrawal form on the following page (www......) or by mail containing your first name, surname, address, order number and indicating without ambiguity that he exercises his right to withdrawal to the following address:

The return is made after reception and confirmation by SAS THITAN.

The cost of returning the product ordered and delivered to the customer will be borne by the customer.

It is the customer's responsibility to provide proof of this return.

The customer will be reimbursed for the full amount of the order, at the invoiced price, with the exception of delivery charges, within 15 days of receipt by SAS THITAN of the returned order. This refund will be made by the same means of payment used for the initial transaction.

The return may be refused by SAS THITAN for the reasons set out above, and the order will then be returned to the customer at the latter's expense, without the latter being able to demand any compensation or right to a refund.

Article 12: Force Majeure

In the event of force majeure as defined by current case law, the performance of SAS THITAN's services will be suspended in whole or in part. Force majeure is defined as any external, unforeseeable or insurmountable event preventing the aforementioned company from fulfilling its contractual obligations.

In the event of the occurrence of an event qualified as force majeure under the preceding paragraph, SAS THITAN undertakes to notify the customer as soon as possible.

Article 13: Disputes, competent court and applicable law

This contract and the GTC governing it are governed by French law, subject to the mandatory rules of the consumer's country of residence.

in the absence of an amicable agreement, any dispute relating to the existence, interpretation, conclusion, performance or termination of the contract, as well as to all documents related to this contract, will fall within the jurisdiction of the Commercial Court of Vienne (38200).
